Terms and Conditions


 

Sales


 

The Company agrees to sell the Goods and the Purchaser orders and agrees to purchase the Goods subject to the Company's Terms and Conditions.

The Company can provide estimates of Goods at their discretion, as general guidance only and the Purchaser should not rely on this estimate. It is the Purchasers responsibility to ensure they have ordered the correct quantity of Goods and the Company shall not be responsible for any surplus or shortfall.

No substitution, modification or variance of these Conditions shall be binding unless specifically accepted by the Company in Writing, even if referred to or included in the document placing the order.

It is the Purchaser's responsibility to ensure and check that all details relating to the order are correct and provide the Company with relevant information relating to the environment in which the goods are intended to be used and for their delivery.

Where goods are supplied in a pattern format, involving different sized Goods needed to complete a pattern the Company reserves the right to only supply the pattern as a whole and not as individual parts constituting the whole.

This Contract replaces and supersedes any prior agreements, written or oral, and any understanding or representation between the Company and the Purchaser. including Company sales staff, in respect of the Goods.


 

Quotations


 

Unless previously amended or withdrawn, The Company’s quotation is valid for 30 days only.

The Company has, by giving notice to the Purchaser the right to change the price of Goods before delivery to reflect any increases in the cost of the Goods to the Company, including increase of the costs of materials, transport, foreign exchange fluctuations and such like.

If the Purchaser receives a notice to change in the Price the Purchaser is entitled to cancel the order without penalty by giving not less than two working days written notice to the Company in writing.

If the Purchaser varies or cancels an order which has been accepted by the Company then the Purchaser shall pay the Company any costs, losses or expenses reasonably and properly incurred or suffered by the Company as a result of the variation or cancellation of the order.

If an order which has been accepted by the Company is either cancelled or varied by the Buyer, then the Buyer shall be responsible to pay the Company any costs, losses, or expenses properly and reasonably incurred or suffered by the Company as a result of the cancellation or variation.


 

Prices and Payment


Prices are subject to alteration or withdrawal without notice.

Prices include VAT but exclude delivery charges.

Orders can only be accepted subject to these Conditions. Goods will be invoiced at Prices ruling on the date of payment.

Liability for payment for Goods shall arise at the time of order.

Payment must be received in full prior to dispatch of the order. If payment is made direct into the Company's bank account then these funds must be cleared before dispatch.

If payment is not received prior to delivery the Company reserves the right to charge interest on any amounts overdue at the rate of 6% above Barclays Bank Plc base rate until the payment is made in full.

Goods that are ordered specially must be paid in full and are not retractable after order.

Goods that are special offer or ex-display are sold as seen and the Purchaser must at the time of purchase satisfy themselves as to the quality and suitability of the Goods and no exchanges or refunds will be given.


 

Product Information and Samples

 

The Company is not liable in respect of natural and geological variations in terms of colour, markings, size and texture and between consignments, which are beyond the Company's control.

All images, descriptions, advertising and specification either in print or on the internet are for the purpose of giving an approximate representation of the Goods only and cannot be guaranteed by the Company.
Any samples supplied are within the Company’s tolerance limits of size, colour variation and texture and the Company cannot guarantee to match shades of the samples presented or any previous orders supplied.

Some natural stones are subject to pitting and chipping and may be easily scratched. All natural tiles are porous and need to be impregnated with industry recognised materials.

The Company recommends that all tiles are blended before installation. Whilst sorting tiles it is normal practice to segregate tiles with unusual colourings and markings and with minor damage so these can be used where tiles are required to be cut in locations that are less visible. Natural stones are susceptible to variations in colour and tone and vary from batch to batch.

It is essential that all stone tiles are allowed to completely dry before installation to be able to assess colour variations. Stone tiles are packed in wet conditions and cannot dry out until unpacked. They will lighten in colour as they dry.

Stone delivered to site must be stored securely in suitable conditions. Stone/tiles delivered to site must always be stacked and stored vertically, on edge. but not on a hard surface to prevent unnecessary damage and edge chipping.

Minor damage to some Goods may occur in transportation or during site handling, cutting and grading and it is the Purchaser's responsibility to consider wastage on each project before ordering.

Orders should always include a 10% allowance for wastage. This is to cover, minor imperfections, cutting and breakages.


 

Delivery, Examination, Reporting Damage and Acceptance

 

Any dates quoted for delivery of the Goods are approximate. The Company will endeavour to have the Goods delivered to the delivery address on the delivery date.

Delivery charges shall be paid by the Purchaser and will vary dependent on size, weight and distance from the Company’s warehouses or suppliers.

Where the Goods are to be delivered in instalments, each delivery shall constitute a separate contract. Failure by the Company to deliver any one or more of the instalments in accordance with these Conditions, or any claim by the Purchaser in respect of any one or more instalments, shall not entitle the Purchaser to treat the Contract as a whole.

The Purchaser is not entitled to cancel any order or refuse delivery if delays are due to circumstances outside the control of the Company.

Goods will be off-loaded at the discretion of the driver at the nearest accessible point to the delivery address, which may be kerbside.

The Purchaser shall inform the Company of any access restrictions and difficulties for a large lorry. The Purchaser must ensure a responsible/suitable person is at the delivery address at the time of delivery to supervise the off-load and to sign for the Goods.

If delivery is unsuccessful either because the Purchaser failed to inform the Company of inaccessibility or restrictions, or because no one was at the delivery address the driver will retain the Goods and the Company will await instructions from the Purchaser. In these instances the Purchaser will be charged an additional delivery charge for every attempt to re-deliver.

The Company takes great care to ensure all Goods leave in perfect condition. Goods delivered to the Purchaser must be checked immediately upon delivery and any incorrect items, damages, shortages must be recorded on the delivery note of the transportation company. Delivery note marked ‘unchecked’ or failure to record damage will be deemed as acceptance as no damage and no shortage and the Company will not accept any claim thereafter.

A written statement of damages and a digital photo of the damaged items should be sent to the Company within 48 hours.

If the Company confirms and accepts damages, shortages and incorrect deliveries the Company will wherever possible remedy this within a further 14 days subject to transportation and availability.

If the damaged Goods is less than 5% of the total order the Company reserves the right not to replace the damaged Goods.

If the Goods are not rejected or returned within 7 working days of delivery, or the Goods have been fixed/fitted or attempted to fix/fit to a wall or floor the Purchaser shall have deemed to have accepted the Goods.


 

Returns and Cancellations

 

No returns will be accepted after 7 working days. In exceptional circumstances, Goods may be accepted for credit. In such circumstances a minimum re-stocking fee of 20% of the Price of the Goods will be charged plus any delivery charges where applicable.

In the unlikely event that the Purchaser is unhappy with the Goods supplied, the Purchaser has the statutory right to cancel this contract within 7 working days of the delivery, except for those orders which were specifically made. The purchase price will be refunded in full on confirmation that the Goods are in the same condition as delivered including original packaging and are returned to the Company within 14 days.

If the damaged Goods is less than 5% of the total order the Company reserves the right not to replace the damaged Goods.

If the Goods are not rejected or returned within 7 working days of delivery, or the Goods have been fixed/fitted or attempted to fix/fit to a wall or floor the Purchaser shall have deemed to have accepted the Goods.


 

The Purchaser shall in all cases pay for the cost of sending the Goods back to the Company and shall pay for the cost of receiving the Goods from the Company.


 

Risk


On delivery to the Purchaser the risk of loss or damage to the Goods shall pass to the Purchaser.

Ownership of the Goods shall not pass to the Purchaser until the Company has received full payment.


 

Liability


No part of this Contract affects the Purchasers statutory rights.

The Company shall not be deemed to be in breach of the Contract or shall not be liable to the Purchaser for any delay or failure to perform any of the Company's obligations in relation to the Goods if the delay or failure was due to the Purchasers act, an Act of God or any cause beyond the reasonable control of the Company.


 

Web Site and Images


The Company reserves the right to change the terms, conditions, and notices under which the Company Web Site is offered.

Our gallery images are protected by English law. You may print them purely for personal use. You may not distribute or post them on public or private websites or distribute them in any other way. You may not alter them or use elements from them unless purely for personal use.


 

General

 

If any provisions of these Conditions is held to be unenforceable or invalid by any competent authority in whole or in part, the validity of the remainder of the provisions of these Conditions shall not be affected.

The Company and the Purchaser agree that this Contract shall be governed by the laws of England and agree to submit to the non exclusive jurisdiction of the English courts.


 

Definitions


The “Company” means affordablemarbletiles.com

The “Purchaser” means any organisation, company, firm or person to whom goods are sold to by the Company.

“Goods” means products supplied by the Company under this Contract.

“Conditions” means the Standard Terms and Conditions of sale set out in this document.

“Price” means the Price of Goods inclusive of VAT, but exclusive of delivery costs.

“Contract” means the contract for the purchase and sale of goods.

“Writing” includes electronic mail, facsimile, telex transmission and any other comparable means of communication.
